Late Payment Interest Calculator UK: 8% + Base Rate, £40–£100
Under the Late Payment of Commercial Debts (Interest) Act 1998 a business can claim simple interest at 8% over the Bank of England base rate in force on the 30 June or 31 December before interest starts, and that rate stays fixed for the debt: 3.75% + 8% = 11.75% for interest that starts in 2026. On top comes a fixed sum of £40, £70 or £100 depending on the size of the debt. Interest runs from the day after the agreed payment date, or 30 days after the invoice if no date was agreed. Interest starts the day after the due date — Days late = payment date minus due date. If no date was agreed, the laws here start the clock 30 days after the invoice is received (Late Payment Act s. 4; Directive 2011/7/EU art. 3). — Late Payment Act 1998, s. 4
Simple interest, day by day — Interest = amount × annual rate × days ÷ 365 — the method GOV.UK shows (8.5% on £1,000 is £85 a year, 23p a day). Italian law defines the default as simple daily interest; German and Turkish law forbid interest on interest (§ 289 BGB, Law 3095 art. 3). — GOV.UK guidance; Late Payment Act s. 1
One rate per period — In the EU laws the rate is reset every 1 January and 1 July, so a debt running across those dates gets one ledger line per period. The UK fixes one rate when interest starts. Turkey sets one rate per calendar year. — SI 2002/1675 art. 4; art. 6:120 BW; art. 5 d.lgs. 231/2002
The Dutch exception: interest on interest — Under Dutch law the unpaid interest of each full year is added to the principal (art. 6:119a(3) BW); the ledger shows that line. — art. 6:119a BW
Part payments — The civil codes of the Netherlands, Germany, France, Italy, Spain, Poland, Romania and Turkey apply a part payment to costs and interest before the principal (for example § 367 BGB, art. 1343-1 Code civil, art. 1194 codice civile). VAT is part of the base in EU law — The EU Court of Justice held that interest runs on the amount due including VAT and that the €40 is owed for each late-paid transaction evidenced by an invoice, even when several invoices are claimed together (C-585/20, 20 October 2022). — CJEU C-585/20
No assumed rates — The table runs from 1 January 2022 to 31 December 2026. If interest would start earlier, or run past the last published period, the tool says so and stops. Rates for 2027 are added when they are published. — Rate tables below, per law

Turkey — commercial default interest (TTK 1530) (TTK art. 1530) — TCMB rate per calendar year — The Central Bank of Turkey announces each January the rate for late payments in business supplies of goods and services, at least 8 points above the commercial default rate of Law 3095 (TTK art. 1530(7)). — 2022: 17.25% · minimum compensation 555.00 TL; 2023: 11.75% · minimum compensation 800.00 TL; 2024: 48.00% · minimum compensation 1,310.00 TL; 2025: 53.25% · minimum compensation 1,475.00 TL; 2026: 43.00% · minimum compensation 2,020.00 TL — Minimum compensation for collection costs, set each year in Turkish lira: TL 2,020.00 for 2026 (TL 1,475.00 for 2025). — No agreed date: 30 days after receipt of the invoice. How much interest can I charge on a late invoice in the UK?
Statutory interest is 8% plus the Bank of England base rate, as simple interest per day. The base rate used is the one in force on the 30 June or 31 December before interest starts, and it stays fixed for that debt: 3.75% + 8% = 11.75% for interest that started in 2026.
Worked example: 11.75% on £2,450 is £287.88 a year, about 79p a day. A debt whose interest started in the second half of 2025 keeps 12.25% (4.25% + 8%), even though Bank Rate fell to 3.75% on 18 December 2025.

Can I charge £40 for every late invoice?
Yes, once per late payment: £40 for a debt under £1,000, £70 from £1,000 to £9,999.99 and £100 from £10,000, on top of the interest (s. 5A of the Act).
The fixed sum is per payment, not per reminder. If your reasonable recovery costs are higher, the difference can be claimed as well. Where the contract sets its own interest rate, GOV.UK states that statutory interest cannot be claimed instead.
When does a payment become late?
The day after the agreed payment date. If no date was agreed, 30 days after the customer received the invoice or you delivered, whichever is later.
Between businesses, an agreed payment date more than 60 days away only stands if it is not grossly unfair to the supplier; otherwise interest runs from day 60 (s. 4 of the Act). Switch the calculator to Invoice date + term to see that check.
My customer is in the EU — which rate applies?
The rate of the law that governs the contract. EU laws take a central-bank rate on 1 January or 1 July and add 8 points (9 in Germany, 10 in France and Poland), plus at least €40 per late-paid invoice.
Pick the law in the calculator and the ledger splits the debt at every 1 January and 1 July. For French road haulage without written payment terms, the standard contract sets five times the legal interest rate instead: 13.75% in the second half of 2026.

How do I keep track of which freight invoices are overdue?
Put the due date on every invoice when you issue it, record each payment against the invoice, and review the open balance per customer every week.
Most disputes about late-payment interest are about dates: when the invoice went out, when it was due, when a part payment arrived. Keeping those three dates on the invoice record settles the calculation above in seconds. The same discipline helps with the fuel surcharge and the commercial invoice: one record, one set of dates.

Common mistakes when claiming late-payment interest
Common mistakes when claiming late-payment interest — Each of these changes the amount — usually in the customer’s favour.
Counting from the invoice date — Interest starts the day after the due date. Counting from the invoice date adds the whole payment term to the claim, which the customer will reject.
One rate for the whole period — In EU laws a debt running across 1 January or 1 July gets two rates. The UK works the other way round: the rate fixed when interest started stays, even if Bank Rate moves.
The fixed sum on every reminder — The £40–£100 (or €40 in the EU) is due once per late payment, not per letter or phone call.
VAT left out of the base — In EU law the amount due includes VAT (CJEU C-585/20). Leaving it out undercounts the interest.
Crediting a part payment to the principal — Most civil codes apply it to interest first. Putting it against the principal lowers the interest you can claim.
Consumer rate instead of commercial rate — In the Netherlands consumers pay 4% statutory interest since 1 January 2026, businesses 10.40% since 1 July 2026. Check that you use the business-to-business rate.

What is the late payment interest rate in the UK in 2026?
8% above the Bank of England base rate. With Bank Rate at 3.75% on 31 December 2025 and on 30 June 2026, it is 11.75% for any debt whose interest starts to run in 2026, fixed for that debt.
Is statutory interest simple or compound?
Simple. The Act gives simple interest; the daily amount is the debt × rate ÷ 365.
Does the rate change if the Bank of England cuts rates?
Not for a debt that is already running: the rate is set by the base rate in force on the 30 June or 31 December before interest started.
How much can I add as a fixed sum?
£40 for a debt under £1,000, £70 from £1,000 to £9,999.99 and £100 from £10,000 — once per late payment. Reasonable recovery costs above that can be claimed too.
Can I use statutory interest if my contract sets a rate?
No. GOV.UK states that statutory interest cannot be claimed if there is a different rate of interest in the contract.
What is the late payment interest rate in the EU?
For the second half of 2026: 10.40% in the Netherlands, Italy and Spain, 12.40% in France, 10.52% in Germany, 13.75% in Poland and 14.50% in Romania, plus at least €40 per late-paid invoice.
Does interest run on the VAT too?
In EU law, yes: the EU Court of Justice held that interest runs on the amount due including VAT (C-585/20). The calculator uses the amount you enter.
