Posting of drivers checker: when you need an IMI declaration
A truck driver is posted when doing cabotage or cross-trade (a transport between two countries, neither of which is the employer's country of establishment) and is not posted on bilateral transport to or from that country, on transit, or on one extra loading or unloading per bilateral leg — two on the return leg if the outbound leg had none (the 1+1 and 0+2 rules). For each Member State where a driver is posted, the operator files one IMI posting declaration per driver at the latest when the posting starts (Directive (EU) 2020/1057, Art. 1). In Logistivo, the declaration PDF can be stored among the driver's documents, where the driver opens it in the Logistivo app at a roadside check.

Goods transport by employed drivers, Directive (EU) 2020/1057 as explained in the European Commission's Q&A on posting in the transport of goods (4 March 2022). Every Commission scenario on this page gives the same result in the checker.

Country where your company is established — The Member State of establishment (Art. 2(8) Reg. 1071/2009) — where the company holds its Community licence, not where the driver lives.

Hauliers from outside the EU: each country sets the rules — Directive 2020/1057 applies to undertakings established in a Member State; its obligations and the IMI portal do not apply directly to operators from third countries, and each Member State decides (Commission Q&A 13 and 16). How the checker decides
It applies Directive 2020/1057 as the Commission explains it for goods transport (Q&A of 4 March 2022). Passenger transport follows different rules (Art. 1(4)) and is not modelled.
Operations are read in the order you add them. On a bilateral leg the first extra activity (outbound) or the first two (return after an outbound without extras) are exempt; each further one is posting from its loading to its unloading (Commission scenario 9).
0+2 is applied only when the return bilateral follows the outbound bilateral (transit in between is ignored). If a cross-trade, cabotage or combined road leg lies in between, the checker uses the one-activity rule — the Commission scenarios do not show that case, so the stricter reading is used.
An unladen journey takes the status of the operation it leads to: driving empty to a cabotage or cross-trade loading point is already posting; driving empty home or to a bilateral loading point is not (Commission Q&A, section V).
Smart tachograph version 2: since 21 August 2023 the extra-activity exemption applies only to vehicles fitted with one; since 19 August 2025 all vehicles operating outside their Member State of registration must have one (Commission tachograph Q&A).

Outside the checker
Only employed drivers are covered; self-employed drivers fall outside Directive 2020/1057 (Commission Q&A 7).
The Directive's controls rely on tachograph records, compulsory for goods vehicles over 3.5 t and, from 1 July 2026, over 2.5 t in international transport or cabotage; where the specific rules do not apply, the general posting rules may still apply (Q&A 9).
Postings through temporary-work agencies or within a group follow the general posting rules, not Art. 1 of Directive 2020/1057 (Art. 1(2); Q&A 4).

How do I submit an IMI posting declaration?
Create a company account on postingdeclaration.eu with EU Login, register the driver and the vehicles, then submit one declaration per driver and per host Member State before the posting starts. The start date cannot be in the past, and a declaration covers from 1 day to 6 months.

(ii) Contact person in the country of establishment — A transport manager or other contact person who liaises with the host authorities and sends and receives documents.
(iii) The driver — Identity, address of residence and driving licence number.
(iv) Employment contract — Start date of the contract and the law applicable to it.
(v) Posting period — Envisaged start and end date — 1 day to 6 months per declaration (Reg. (EU) 2021/2179).

How this works in Logistivo — File the declaration in the Commission's portal, then keep the copy and the trip evidence together in Logistivo's driver module and load management:
Upload the declaration PDF to the driver's profile as an "Other driver document" and set the posting end date as its validity — the driver opens it in the Logistivo app on iOS or Android, so the copy is in the cab in electronic form.
Documents with a validity date appear in the document expiry report Logistivo e-mails every two weeks (windows up to 120 days).
Each loading and unloading stop of a load is stored with its address and the time the driver marked it completed in the app, and the load's status history is time-stamped — the record to answer an 8-week document request.
The CMR consignment note is produced from the load data (sender, consignee, carrier, places and dates of loading and delivery, goods, plates), ready to print and sign.
While posted, the driver is entitled to the remuneration and core working conditions of the host Member State; when not posted, those of the country of establishment apply.
Posted: host-country pay — For the time spent in the host Member State on cabotage, cross-trade or a non-exempt extra activity, the host country's mandatory constituent elements of remuneration apply. Each Member State must publish them (Art. 1(9)).
Not posted: pay of the country of establishment — Bilateral transport, transit and exempt extra activities stay under the pay rules of the country where the employer is established (Commission factsheet).

When is a truck driver considered posted?
When the driver performs cabotage or cross-trade in a Member State other than the employer's country of establishment — and on extra loading/unloading beyond the 1+1 / 0+2 limits. Bilateral transport, transit and exempt extra activities are not posting.
The dividing line is the link with the host country (recital 9): the more the work is tied to the host territory, the more the posting rules apply. Cabotage is always posting (Art. 1(7)); a road leg of combined transport is posting only if it is not bilateral on its own (Art. 1(6)).
Empty driving follows the operation it serves: driving unladen to a cabotage loading point is already posting; driving home empty is not.
No. A transport from the country of establishment to another country — EU or not — or back is bilateral, and the driver is not posted (Art. 1(3)).
Several bilateral consignments on one journey (partial unloadings in Germany, Belgium and France of goods loaded at home) are all bilateral. Extra activities that do not touch the home country are limited: one per leg, or two on the return if the outbound had none — only with a smart tachograph version 2.
At the roadside the driver shows the transport evidence (e-CMR or equivalent) and the tachograph records — no declaration.
Who files the IMI declaration, and how do I log in?
The employer files it — never the driver — through postingdeclaration.eu, the only official portal, after logging in with EU Login.
The portal has been the only system for EU operators since 2 February 2022; national portals such as SIPSI (FR), MILOG (DE) or Meldloket (NL) are no longer used for drivers under Directive 2020/1057 (Commission Q&A 15).
One declaration per driver: in multi-manning both drivers need one, even the one who is not driving in that country (Q&A 17).
Operators established outside the EU and the UK cannot use the portal; national rules apply (Q&A 16).
What documents must a posted driver carry?
Three: a copy of the IMI declaration, evidence of the transport operations in the host country (e-CMR or Art. 8(3) evidence) and the tachograph records with the country symbols — on paper or electronically.
Inspectors may not ask the driver for other posting documents at the roadside; the list is closed (Commission Q&A 20). Contracts, payslips and time sheets are requested from the operator afterwards via IMI, within 8 weeks.
In Logistivo — The declaration PDF stored among the driver's documents is on the driver's phone in the Logistivo app; the CMR note is generated from the load, and each stop carries the completion time the driver recorded.
Do UK hauliers and EU drivers going to the UK need posting declarations?
EU hauliers carrying goods between the UK and an EU Member State are exempt from posting rules under the EU–UK TCA; cabotage in the UK by an EU haulier is posting and needs a declaration. UK operators posting drivers in the EU follow the TCA and can use the EU portal.
Germany and France confirm that UK hauliers may file through IMI (Zoll; French Ministry of Ecological Transition). Transport between the UK and non-EU countries is outside the TCA section on posting (Commission Q&A 10).
Do the rules change for drivers from outside the EU?
Not for the posting test: what counts is where the employer is established. A driver from a third country employed by an EU haulier is posted exactly like an EU driver, and the employer files the IMI declaration.
Such a driver also needs a driver attestation issued by the employer's Member State (Reg. 1072/2009, Art. 5), and stays in the Schengen area are counted separately under the 90/180-day rule.

What is a posting declaration for drivers?
A notification a haulier files through the Commission's IMI portal (postingdeclaration.eu) before a driver is posted to another Member State for cabotage or cross-trade; it lists the operator, a contact person, the driver, the contract, the posting period, the plates and the type of operation (Directive 2020/1057, Art. 1(11)(a)).
How long is an IMI posting declaration valid?
From 1 day to 6 months, as entered in the declaration; for a longer period a new declaration is needed (Reg. (EU) 2021/2179, Art. 2; postingdeclaration.eu).
Is a driver posted when unloading in another EU country and returning empty?
No. A bilateral transport followed by an unladen return to the country of establishment is not posting (Commission scenario 12).
Does the 3-in-7 cabotage limit change the posting rule?
No. Every cabotage operation is posting (Art. 1(7)); the cabotage limits of Reg. 1072/2009 decide whether the cabotage is allowed at all.
What if the operator misses the 8-week deadline for documents?
The host authority may ask the authority of the country of establishment for assistance via IMI, which must supply the documents within 25 working days (Art. 1(11)(c)).
Can shippers and forwarders be fined for a carrier's posting breach?
Yes, Member States must set sanctions for consignors, freight forwarders, contractors and subcontractors who knew or ought to have known of the breach (Art. 5(1); Commission Q&A 23).
